Winner
The Second Circuit overturned the conviction of Doug Mackey for a conspiracy charge. The court did not rule on any of the critical constitutional rights issues Mackey’s lawyers put forth as the grounds for appeal. They stated that there was not enough evidence to convict. After four and a half years, Mackey can enjoy relief.
This is a win, but a small win. All of the apparatchiks involved with investigating and prosecuting a young man for sending a joke tweet can feel comfortable with their actions. They face no consequences. In a decent world, they would face ruin and the harassment and pressure Mr. Mackey faced since January 2021. In that same decent world, the government never would have charged Mackey. We can hope that the Trump admin fires the remaining feds in the bureaucracy that made this happen.
What this likely signals is that the Biden admin was the contemporary high water mark for censorship. It may come back in the future, but the environment of 2025 is far superior to 2021. Hopefully, Doug Mackey can put this all behind him and enjoy the rest of his life. Considering how strong he stood throughout this ordeal, he will forever be a Meme War legend.
Losers
The Feds - They did their cheka duties and got their man but now will face a lawsuit from Mackey for malicious prosecution.
Microchip - He still has to serve whatever his plea deal agreement specified, plus no Mackey conviction means more time.
Chuck Johnson - He crowed about Mackey’s prosecution. Years later, Chuck is the one allegedly needing a court appointed lawyer and facing the possibility of jail.
